South Carolina Industrial and Janitorial Services Company Settles Sexual Harassment Case
On April 27, 2020, the Equal Employment Opportunity Commission reported that HM Solutions, a S.C. janitorial and industrial services company, settled a 4-plaintiff sexual harassment lawsuit for $315,000. The Charges allege that the harassment was perpetrated by a male supervisor and male manager, towards the 4 female employees. Despite other supervisors witnessing the harassment, the Charge alleges, they never did anything to prevent the harassment. In fact, the Charge alleges, the victims complained about the sexual harassment, but it continued, and they were later terminated in retaliation for no acquiescing to the sexual abuse.
This case demonstrates the power of "strength in numbers". If sexual harassment victims are able to get other timely victims to bring the case with them and/or are able to get willing witnesses to come forward to corroborate the harassment, it greatly strengthens the case. If you have experienced sexual harassment at work, it's good to keep the list of potential other victims and witnesses (and their job title and contact information) who may step forward to support you or join the case. You should reach out to an experienced sexual harassment attorney as soon as possible, since the statute of limitations is short and an absolute bar to relief.
